Terms of Service

The agreement between you and MyDailyCheck.

Service description

MyDailyCheck provides automated daily wellness check-ins via phone call and/or text message. The service contacts a designated individual ("loved one") at a scheduled time and reports their response status to authorized family members or caregivers through a web-based dashboard.

Not a medical device or emergency service

MyDailyCheck is NOT a medical device, medical alert system, or emergency response service. It is not a substitute for 911, emergency medical services, or professional medical care. MyDailyCheck does not provide medical advice, diagnosis, or treatment.

If you believe someone is experiencing a medical emergency, call 911 immediately. Do not rely on MyDailyCheck to summon emergency help.

User responsibilities

  • You agree to provide accurate contact information for yourself, your loved ones, and emergency contacts.
  • You agree to inform your loved one that you are setting up MyDailyCheck for them. We will verify their consent before beginning daily check-ins.
  • You are responsible for keeping your contact tree up to date and ensuring emergency contacts are aware of their role.
  • You understand that MyDailyCheck is a communication tool and does not guarantee the safety or well-being of any individual.

Consent requirements

Before any daily check-ins begin, MyDailyCheck will contact the loved one directly to explain the service and request their explicit consent. If they decline, no check-ins will be placed. This consent requirement is non-negotiable and exists to protect the dignity and autonomy of the person being checked on.

CRTC and CASL compliance

MyDailyCheck only contacts individuals who have provided explicit consent to receive calls and/or text messages. We comply with the Canadian Radio-television and Telecommunications Commission (CRTC) regulations and Canada's Anti-Spam Legislation (CASL). You can opt out at any time by replying STOP to any text message or contacting us directly.

Service availability

We strive to provide reliable, uninterrupted service. However, MyDailyCheck is provided on a "best effort" basis. We do not guarantee 100% uptime or that every call or text will be delivered successfully. Telecommunications disruptions, carrier issues, power outages, and other factors beyond our control may occasionally affect service delivery.

We are not liable for any harm, injury, or loss that results from a missed or undelivered check-in call or text message.

Billing

Free plan users are not charged. Paid plans are billed monthly. You may cancel at any time. Cancellation takes effect at the end of the current billing period. We do not provide refunds for partial months.

Limitation of liability

To the maximum extent permitted by law, MyDailyCheck (operated by YourTech Limited) shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of life, personal injury, or emotional distress, arising out of or related to your use of the service.

MyDailyCheck is a wellness check-in communication tool. It is not an emergency response system. Our total liability for any claim arising from the service shall not exceed the amount you paid for the service in the twelve months preceding the claim.

Governing law

These Terms of Service are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein. Any disputes arising from these terms shall be resolved in the courts of Ontario, Canada.

Changes to these terms

We may update these Terms of Service from time to time. When we make significant changes, we will notify you by email or through a notice on our website. Your continued use of MyDailyCheck after changes take effect constitutes acceptance of the updated terms.
